The tribunals determine whether an individual is an enemy combatant. Needless to say, the cards are stacked against the prisoner from the get-go. The tribunals are allowed to rely on hearsay evidence and information acquired though coercion. Any evidence deemed "secret" is withheld from the prisoner. Can you imagine trying to defend yours

For more than 200 years, the courts have served as the ultimate safeguard for our civil liberties. A critical part of this role has been the judicial branch's ability to consider writs of habeas corpus. However, because of a provision of the Military Commissions Act passed last fall, this fundamental role of the courts has been seriously reduced.

No, Mr. Gonzales, the Constitution does NOT say that every individual is guaranteed the right of habeas corpus! No, Mr. Specter, rights DO exist even if they're not listed in the Constitution. The text of the Constitution guarantees that YOU and your accomplices in the federal government cannot take that right away!
